Aquino, known as Cory to millions of Filipinos, has died, her family said on August 1, 2009. She was 76.
REUTERS/Romeo Ranoco/Files

By HRVOJE HRANJSKI, Associated Press Writer Hrvoje Hranjski, Associated Press Writer

MANILA, Philippines – Former President Corazon Aquino, who swept away a dictator with a "people power" revolt and then sustained democracy by fighting off seven coup attempts in six years, died on Saturday, her son said. She was 76.

The uprising she led in 1986 ended the repressive 20-year regime of Ferdinand Marcos and inspired nonviolent protests across the globe, including those that ended Communist rule in eastern Europe.

But she struggled in office to meet high public expectations. Her land redistribution program fell short of ending economic domination by the landed elite, including her own family. Her leadership, especially in social and economic reform, was often indecisive, leaving many of her closest allies disillusioned by the end of her term.

Still, the bespectacled, smiling woman in her trademark yellow dress remained beloved in the Philippines, where she was affectionately referred to as "Tita (Auntie) Cory."

"She was headstrong and single-minded in one goal, and that was to remove all vestiges of an entrenched dictatorship," Raul C. Pangalangan, former dean of the Law School at the University of the Philippines, said earlier this month. "We all owe her in a big way."

Her son, Sen. Benigno "Noynoy" Aquino III, said she died at 3:18 a.m. Saturday (1918 GMT Friday).

Aquino was diagnosed with advanced colon cancer last year and confined to a Manila hospital for more than a month. Her son said the cancer had spread to other organs and she was too weak to continue her chemotherapy.

For the past month, supporters have been holding daily prayers for Aquino in churches in Manila and throughout the country. Requiem Masses were scheduled for later Saturday, and yellow ribbons were tied on trees around her neighborhood in Quezon city.

President Gloria Macapagal Arroyo, who is on an official visit to the United States, remembered Aquino as a "national treasure" who helped lead "a revolution to restore democracy and the rule of law to our nation at a time of great peril.

"She picked up the standard from the fallen warrior Ninoy and helped lead our nation to a brighter day," Arroyo said, referring to Aquino' husband, opposition leader Benigno "Ninoy" Aquino Jr., who was assassinated in 1983.

She said the Philippines will observe 10 days of national mourning. The Armed Forces of the Philippines said it would accord full military honors during Aquino's wake, including gun salutes and lowering flags to half-staff.

TV stations on Saturday ran footage of Aquino's years in power together with prayers while her former aides and supporters offered condolences.

"Today our country has lost a mother," said former President Joseph Estrada, calling Aquino "a woman of both strength and graciousness."

Even the exiled Communist Party founder Jose Maria Sison, whom Aquino freed from jail in 1986, paid tribute from the Netherlands.

Aquino's unlikely rise began in 1983 after her husband was gunned down on the tarmac of Manila's international airport as he returned from exile in the United States to challenge Marcos, his longtime adversary.

The killing enraged many Filipinos and unleashed a broad-based opposition movement that thrust Aquino into the role of national leader.

"I don't know anything about the presidency," she declared in 1985, a year before she agreed to run against Marcos, uniting the fractious opposition, the business community, and later the armed forces to drive the dictator out.

Maria Corazon Cojuangco was born on Jan. 25, 1933, into a wealthy, politically powerful family in Paniqui, about 75 miles (120 kilometers) north of Manila.

She attended private school in Manila and earned a degree in French from the College of Mount St. Vincent in New York. In 1954 she married Ninoy Aquino, the fiercely ambitious scion of another political family. He rose from provincial governor to senator and finally opposition leader.

Marcos, elected president in 1965, declared martial law in 1972 to avoid term limits. He abolished the Congress and jailed Aquino's husband and thousands of opponents, journalists and activists without charges. Aquino became her husband's political stand-in, confidant, message carrier and spokeswoman.

A military tribunal sentenced her husband to death for alleged links to communist rebels but, under pressure from U.S. President Jimmy Carter, Marcos allowed him to leave in May 1980 for heart surgery in the U.S.

It was the start of a three-year exile. With her husband at Harvard University holding court with fellow exiles, academics, journalists and visitors from Manila, Aquino was the quiet homemaker, raising their five children and serving tea. Away from the hurly-burly of Philippine politics, she described the period as the best of their marriage.

The halcyon days ended when her husband decided to return to regroup the opposition. While she and the children remained in Boston, he flew to Manila, where he was shot as he descended the stairs from the plane.

The government blamed a suspected communist rebel, but subsequent investigations pointed to a soldier who was escorting him from the plane on Aug. 21, 1983.

Aquino heard of the assassination in a phone call from a Japanese journalist. She recalled gathering the children and, as a deeply religious woman, praying for strength.

"During Ninoy's incarceration and before my presidency, I used to ask why it had always to be us to make the sacrifice," she said in a 2007 interview with The Philippine Star newspaper. "And then, when Ninoy died, I would say, 'Why does it have to be me now?' It seemed like we were always the sacrificial lamb."

She returned to the Philippines three days later. One week after that, she led the largest funeral procession Manila had seen. Crowd estimates ranged as high as 2 million.

With public opposition mounting against Marcos, he stunned the nation in November 1985 by calling a snap election in a bid to shore up his mandate. The opposition, including then Manila Archbishop Cardinal Jaime L. Sin, urged Aquino to run.

After a fierce campaign, the vote was held on Feb. 7, 1986. The National Assembly declared Marcos the winner, but journalists, foreign observers and church leaders alleged massive fraud.

With the result in dispute, a group of military officers mutinied against Marcos on Feb. 22 and holed up with a small force in a military camp in Manila.

Over the following three days, hundreds of thousands of Filipinos responded to a call by the Roman Catholic Church to jam the broad highway in front of the camp to prevent an attack by Marcos forces.

On the third day, against the advice of her security detail, Aquino appeared at the rally alongside the mutineers, led by Defense Minister Juan Ponce Enrile and Lt. Gen. Fidel Ramos, the military vice chief of staff and Marcos' cousin.

From a makeshift platform, she declared: "For the first time in the history of the world, a civilian population has been called to defend the military."

The military chiefs pledged their loyalty to Aquino and charged that Marcos had won the election by fraud.

U.S. President Ronald Reagan, a longtime supporter of Marcos, called on him to resign. "Attempts to prolong the life of the present regime by violence are futile," the White House said. American officials offered to fly Marcos out of the Philippines.

On Feb. 25, Marcos and his family went to the U.S.-run Clark Air Base outside Manila and flew to Hawaii, where he died three years later.

The same day, Aquino was sworn in as the Philippines' first female leader.

Over time, the euphoria fizzled as the public became impatient and Aquino more defensive as she struggled to navigate treacherous political waters and build alliances to push her agenda.

"People used to compare me to the ideal president, but he doesn't exist and never existed. He has never lived," she said in the 2007 Philippine Star interview.

The right attacked her for making overtures to communist rebels and the left, for protecting the interests of wealthy landowners.

Aquino signed an agrarian reform bill that virtually exempted large plantations like her family's sugar plantation from being distributed to landless farmers.

When farmers protested outside the Malacanang Presidential Palace on Jan. 22, 1987, troops opened fire, killing 13 and wounding 100.

The bloodshed scuttled talks with communist rebels, who had galvanized opposition to Marcos but weren't satisfied with Aquino either.

As recently as 2004, at least seven workers were killed in clashes with police and soldiers at the family's plantation, Hacienda Luisita, over its refusal to distribute its land.

Aquino also attempted to negotiate with Muslim separatists in the southern Philippines, but made little progress.

Behind the public image of the frail, vulnerable widow, Aquino was an iron-willed woman who dismissed criticism as the carping of jealous rivals. She knew she had to act tough to earn respect in the Philippines' macho culture.

"When I am just with a few close friends, I tell them, 'OK, you don't like me? Look at the alternatives,' and that shuts them up," she told America's NBC television in a 1987 interview.

Her term was punctuated by repeated coup attempts — most staged by the same clique of officers who had risen up against Marcos and felt they had been denied their fair share of power. The most serious attempt came in December 1989 when only a flyover by U.S. jets prevented mutinous troops from toppling her.

Leery of damaging relations with the United States, Aquino tried in vain to block a historic Senate vote to force the U.S. out of its two major bases in the Philippines.

In the end, the U.S. Air Force pulled out of Clark Air Base in 1991 after the eruption of Mount Pinatubo forced its evacuation and left it heavily damaged. The last American vessel left Subic Bay Naval Base in November 1992.

After stepping down in 1992, Aquino remained active in social and political causes.

Until diagnosed with colon cancer in March 2008, she joined rallies calling for the resignation of President Arroyo over allegations of vote-rigging and corruption.

She kept her distance from another famous widow, flamboyant former first lady Imelda Marcos, who was allowed to return to the Philippines in 1991.

Marcos has called Aquino a usurper and dictator, though she later led prayers for Aquino in July 2009 when the latter was hospitalized. The two never made peace.

___
Associated Press writers Jim Gomez and Oliver Teves contributed to this report.

Source: Yahoo! Cookie Chua)

On the heels of the success of his debut Sony (BMG) release “Diploma,” Gloc 9 releases the follow-up album which interestingly was titled “Matrikula.”

The album is a collection of collaborations from the who’s who of the music industry – featuring Gloc 9’s remarkable rapping style. Notable names included in the album are Noel Cabangon (Bayad Ko), Gabby Alipe of Urbandub (Balita), Raymund Marasigan (Pangarap), Cookie Chua (Tao) and a host of other performers.

Initial single release from the set is his collaboration with Zelle in the track “Upuan” which is a politically-flavored track, one that puts those in power in an instant spotlight.

From this line-up alone, plus the dedication that the artist puts in interpreting the songs, it will be a clear indication that the new album can very well pass as Gloc 9’s matrikula which deserves him to earn the diploma and be included in the honor roll of the local music industry’s 2009 album releases!

Video Copy Quality

CAM
A cam is a theater rip usually done with a digital video camera. A mini tripod is sometimes used, but a lot of the time this wont be possible, so the camera might shake. Also seating placement isn’t always idle, and it might be filmed from an angle. Sound is taken from the onboard microphone of the camera, and especially in comedies, laughter can often be heard during the film. Due to these factors picture and sound quality are usually quite poor.

TELESYNC (TS)
A telesync is the same spec as a CAM except it uses an external audio source (most likely an audio jack in the chair for hard of hearing people). A direct audio source does not ensure a good quality audio source, as a lot of background noise can interfere. A lot of the times a telesync is filmed in an empty cinema or from the projection booth with a professional camera, giving a better picture quality.

TELECINE (TC)
A telecine machine copies the film digitally from the reels. Sound and picture should be very good, but due to the equipment involved and cost telecines are fairly uncommon. Generally the film will be in correct aspect ratio, although 4:3 telecines have existed.

SCREENER (SCR)
A pre VHS tape, sent to rental stores, and various other places for promotional use. A screener is supplied on a VHS tape, and is usually in a 4:3 (full screen) a/r, although letterboxed screeners are sometimes found. The main draw back is a “ticker” (a message that scrolls past at the bottom of the screen, with the copyright and anti-copy telephone number). Depending on the equipment used, screener quality can range from excellent if done from a MASTER copy, to very poor if done on an old VHS recorder thru poor capture equipment on a copied tape.

DVD-SCREENER (DVDscr)
Same premise as a screener, but transferred off a DVD. Usually letterbox , but without the extras that a DVD retail would contain. The ticker is not usually in the black bars, and will disrupt the viewing. If the ripper has any skill, a DVDscr should be very good.

DVDRip
A copy of the final released DVD. If possible this is released PRE retail (for example, Star Wars episode 2) again, should be excellent quality.

WORKPRINT (WP)
A workprint is a copy of the film that has not been finished. It can be missing scenes, music, and quality can range from excellent to very poor. Some WPs are very different from the final print (Men In Black is missing all the aliens, and has actors in their places) and others can contain extra scenes (Jay and Silent Bob) .

R5 or R5.Line
R5 releases differ from normal releases in that they are a direct Telecine transfer of the film without any of the image processing. They take the information from the DVD disc and sync it to an English version of the film, usually a previously released version. Which means that the sound often isn’t as good as DVDRips. In some cases, R5 DVDs may be released without an English audio track, requiring pirates to use the direct line audio from the film’s theatrical release. In this case, the pirated release should be tagged with “.LINE” to distinguish it from a release with a DVD audio track.

Source: vcdquality.com

Donor: tita06830

tita06830
Donation Received. Swine flu viruses cause high levels of illness and low death rates in pigs. Swine influenza viruses may circulate among swine throughout the year, but most outbreaks occur during the late fall and winter months similar to outbreaks in humans. The classical swine flu virus (an influenza type A H1N1 virus) was first isolated from a pig in 1930.

Download Powerpoint Presentation for more info.

Download: swineinfluenza.ppt@honeybytes.blogspot.com.rar

Martin Nievera’s Version of Lupang Hinirang is Against the Law

NHI Claims Martin Nievera’s Version of ‘Lupang Hinirang’ is Against the Law

Teddy Atienza, head of the Heraldry Division of the National Historical Institute (NHI), said Martin Nievera violated Section 37 of the Republic Act No. 8491 by NOT singing the Philippine National Anthem in accordance with the musical arrangement of its composer Julian Felipe.

“Mali ang pagkanta niya…dapat sinundan niya ang nakalagay sa batas,” Atienza said in a radio interview criticizing Martin Nievera’s version that the crooner sang at the Pacquiao-Hatton bout as against the law.

He even stressed that violators of this law will have to pay a fine between P5,000 and P20,000 or spend up to a year in prison. He asked Martin to ask for public apology for “tweaking” the Philippine National Anthem.

To add insult to the injury, the logo of the National Historical Institute was flashed right after Martin Nievera hit the final note.

On the other hand, Martin Nievera issued a statement on 24 Oras saying he will not apologize.

“My boss, Manny Pacquiao told me, ‘basta wag yung mabagal. Martin became the first male artist to sing the Philippine National Anthem in all of Pacman’s bouts after more than 10 female artists.

It’s interesting to note that in the past, the National Historial Institute (NHI) also reprimanded Charice, Jennifer Bautista and Christian Bautista for deviating from the song’s original form.

All three singers have apologized, saying it was not their intention that some notes or lines in the song were changed or omitted.

Source: <a Philippines—Senator Alan Peter Cayetano has filed a resolution setting aside P100 million as an incentive to anyone who can convincingly demonstrate the weakness of the automated poll system.

Cayetano, at a press conference Friday, said that if any IT expert can establish that the system to be used in the 2010 polls is not secure from fraud and tampering, “Comelec should cancel the contract, save the P11 billion and sue for damages the contractor in the event of such successful hacking.”

He said he would rather revert to the manual counting of votes if the computerized system would lead to wholesale cheating.

Cayetano said the resolution, which he would file on Monday, was in response to a statement by a Comelec official challenging cyber security experts to test the system for weaknesses.

“The most effective way to test if indeed a system is credible, reliable and tamper-proof or fraud-proof is to offer a sizable prize to whoever can hack and convincingly show the weaknesses of the system,” Cayetano said in his draft resolution.

“To make the said incentive system work, there is a need to authorize the Commission on Elections to set aside the amount not exceeding P100 million to be utilized as a prize money for the said successful hacker,” he said.

If the system is successfully hacked, the Comelec will then be authorized to cancel the contract and sue the winning bidder.

Despite repeated assurances poll automation will significantly curb cheating, Cayetano said there are fears it might actually induce a “bigger and more sophisticated method of election cheating if the system is vulnerable to manipulation.”

Source: <a As is often the case, that date is April 1.

Malware creators love to target April Fool's Day with their wares, and the latest worm, called Conficker C, could be one of the most damaging attacks we've seen in years.

Conficker first bubbled up in late 2008 and began making headlines in January as known infections topped 9 million computers. Now in its third variant, Conficker C, the worm has grown incredibly complicated, powerful, and virulent... though no one is quite sure exactly what it will do when D-Day arrives.

Thanks in part to a quarter-million-dollar bounty on the head of the writer of the worm, offered by Microsoft, security researchers are aggressively digging into the worm's code as they attempt to engineer a cure or find the writer before the deadline. What's known so far is that on April 1, all infected computers will come under the control of a master machine located somewhere across the web, at which point anything's possible. Will the zombie machines become denial of service attack pawns, steal personal information, wipe hard drives, or simply manifest more traditional malware pop-ups and extortion-like come-ons designed to sell you phony security software? No one knows.

Conficker is clever in the way it hides its tracks because it uses an enormous number of URLs to communicate with HQ. The first version of Conficker used just 250 addresses each day -- which security researchers and ICANN simply bought and/or disabled -- but Conficker C will up the ante to 50,000 addresses a day when it goes active, a number which simply can't be tracked and disabled by hand.

At this point, you should be extra vigilant about protecting your PC: Patch Windows completely through Windows Update and update your anti-malware software as well. Make sure your antivirus software is actually running too, as Conficker may have disabled it.

Microsoft also offers a free online safety scan here, which should be able to detect all Conficker versions.

source: Yahoo!Tech

For Sale: Nikon D80 DSLR Camera (10.2mp)

What's in the box?

D80 DSLR Camera (Body)

Nikon AF Nikkor Lens, 70-300mm, auto focus

Nikon Li-ion Battery Pack

SD Memory Card, 4Gb

Nikon Tripod

Lowerpro Camera Bag

<img style="width: 323px; When the interviewer asks you, "So, do you have any questions for me?" the last thing? You want to say is "No." But that could be the best option if you're at a loss for words, because some interview questions are better left unasked.

Here are 10 highly unsuitable interview questions that should never make an appearance, unless you don't want the job:

"What does your company do?"
This was a reasonable interview question in 1950 or in 1980, before the Internet existed. Today, it's your job to research any company you're interviewing with before setting foot in the door. We need to show up for a job interview knowing what the employer does, who its competitors are, and which of its accomplishments (or challenges) have made the news lately.

"Are you going to do a background check?"
It is amazing how many job candidates ask this question, which provokes alarm on the part of the interviewer, instead of the more general, "Can you please tell me a little about your selection process, from this point on?" Lots of people have credit issues that cause them worry during a job search, or aren't sure how solid their references from a previous job might be. If you're invited for a second interview, you can broach any sensitive topics from your past then. Asking "Will you do a background check?" makes you look like a person with something to hide.

"When will I be eligible for a raise?"
Companies fear underpaying people almost as much as they fear overpaying them, because a person who's underpaid vis-a-vis his counterparts in the job market is a person with one eye on the career sites. Instead of asking about your first raise before you've got the job, you can ask (at a second interview) "Does your organization do a conventional one-year performance and salary review?"

"Do you have any other jobs available?"
A job search requires quick thinking about straight talk, and if a job is far below your abilities, you're better off saying so than beating around the bush with this question. You don't have to take yourself out of the running; you can say, "The job sounds interesting, but frankly I was earning 30% more and supervising people in my last job. Could you help me understand the career path for this role?" That's the cue for the interviewer, if he or she is on the ball, to highlight another job opening that might exist.

"How soon can I transfer to another position?"
You're broadcasting "I'm outta here at the first chance" when you ask this question. If you like the job, take the job. If it's not for you, wait for the right opportunity. Almost every employer will keep you in your seat for at least one year before approving an internal transfer, so a job-search bait-and-switch probably won't work out the way you'd hoped.

"Can you tell me about bus lines to your facility?"
Get online and research this yourself. It's not your employer's problem to figure out how you get to work.

"Do you have smoking breaks?"
If you're working in retail or in a call center, you could ask about breaks. Everyone else, keep mum; if your need to smoke intrudes so much on your work life that you feel the need to ask about it, ask your best friend or significant other for smoking-cessation help as a new-job present. Lots of companies don't permit smoking anywhere on the premises, and some don't like to hire smokers at all. Why give an employer a reason to turn you down?

"Is [my medical condition] covered under your insurance?"
This is a bad question on two counts. You don't want to tell a perfect stranger about your medical issues, especially one who's deciding whether or not to hire you. Ask to see a copy of the company's benefits booklet when an offer has been extended. This is also a bad question from a judgment standpoint; no department managers and only a tiny percentage of HR people could be expected to know on a condition-by-condition basis what's covered under the health plan. Anyway, your pre-existing condition won't be covered under most corporate plans for at least a year.

"Do you do a drug test?"
If you have a philosophical objection to drug tests, wait until they ask you to take a drug test and tell them about your objection. Otherwise, your question sounds like, "I'd fail a drug test," so don't ask.

"If you hire me, can I wait until [more than three weeks from now] to start the job?"
Employers expect you to give two weeks' notice. If you're not working, they'd love to see you more quickly. If you ask for tons of time off before you start working -- unless you have a very good reason -- the employer may think, "How serious is this candidate about working?" In any case, a start-date extension is something to request after you've got the offer in hand, not before.

Liz Ryan is a 25-year HR veteran, former Fortune 500 VP and an internationally recognized expert on careers and the new millennium workplace. If you can get in front of the people making a hiring decision, that means that you've already moved from a group of perhaps 100 resumes to a field of just a few serious contenders. At that point, your chance of getting a job offer improves dramatically.

Of course, having surmounted that huge hurdle, the last thing you want to do is blow it. To that end, here are 10 job-interview gaffes to avoid.

Complaining about the parking or directions.
Don't think it doesn't happen! As cordial and happy-go-lucky as your interviewers may seem, they don't want to hear a job-seeker complain that the place was hard to find or that the parking is inconvenient. The best (that is, the worst) example of this I ever experienced as an HR person came from the candidate who said, "Seven handicapped parking spaces next to the front door? What, are you having a wheelchair convention or something?" That was a short interview.

Bad-mouthing your previous job, manager, or company.
If you've been laid off or suffered some other unpleasant experience at your last job, it's easy to launch into a litany of everything the old employer did wrong. Don't do it! The interviewer is bound to wonder "Will this person be bashing me behind my back on some future interview, too?" Zip it.

Digging into details off the bat.
The typical selection process allows plenty of time for you to learn everything you need to know about the company's dental plan, its tuition-reimbursement policy, and the size of your cubicle. Don't ask about any of these items on a first interview, when you should be focusing the conversation on the role and the organization.

Groveling.
Employers want to hire people who can do the jobs and who are enthusiastic about the work. What's not so appealing is the candidate whose every word and gesture conveys the message, "Hire me, I beg you!" Joblessness is no fun, but you don't help your chances of getting the nod by presenting yourself as a candidate whose most notable attribute is desperation.

Answering a question before you understand it.
The absolute worst answer to any interview question is the response that shows you weren't really listening. When an interviewer asks a question that requires thought, like, "Tell me about a time when you had to convince a team of people to change gears," you don't want to blurt out, "Oh, I've done that a million times!" Any "tell me about a time when" question is a question that the interviewer has chosen to elicit a specific problem/solution story from you. Take the time to think through the question and compose a thoughtful answer. A few minutes of silence in the room won't kill anybody.

Spacing out.
Any interviewer worth her salt will be able tell when you've zoned out. If you're wondering whether the 5:40 train will get you home in time to watch the playoff game, the interviewer will spot it in your eyes. If you're really out of it, he may throw you a curve ball like, "So, who would you say was the most effective member of Teddy Roosevelt's cabinet, and why?" Stay in the room, with your eyes either meeting the interviewer's or looking thoughtfully at the ceiling. Or your shoes.

Slouching.
We'll throw in tipping the chair back off its front legs, resting your head on your hand, and lacing your fingers together behind your head.

Cursing.
Interviewers love to put job candidates at ease. When you reach the state of ease that lets an "f-bomb" escape your lips, you've gone too far.

"Opening the kimono."
It's tempting to share with a sympathetic interviewer the news that this job search has been really hard, that you're not getting callbacks, and that you've already sent out 150 resumes. Don't do it. Smart job candidates put out a vibe that says, "I'm glad to be here with you and this job might be fun, but I'm a capable person who's aware of his value on the job market."

Doing anything disgusting.
The long list of personal gross factors includes picking one's teeth or nose, spitting, and other unmentionables that are best left to the imagination. Any of these is a sure-fire interview-killer (and can we really blame the employer for that?). One candidate asked me for a cup of water, took a sip, swished it around in his mouth, and spat into a potted plant. Niiiiiice!

Liz Ryan is a 25-year HR veteran, former Fortune 500 VP and an internationally recognized expert on careers and the new millennium workplace. Miriam Defensor-Santiago was stripped yesterday by her colleagues of the lead role in the investigation of the World Bank’s report of anomalies – with witnesses implicating First Gentleman Jose Miguel Arroyo – in the awarding of government road contracts.

Senate President Juan Ponce Enrile told reporters that the committee on economic affairs chaired by Santiago may continue with its hearing but only on the economic aspect of the issue. Other senators, Enrile said, may file a resolution giving another committee, possibly the Blue Ribbon, the task of investigating the case’s criminal aspect.

Enrile declined to say whether the decision was a result of criticisms of the way Santiago presided over the two hearings on the issue.

Some senators, particularly Sen. Panfilo Lacson, said the hearings appeared staged and intended to clear Mr. Arroyo of any liability.

Enrile said there was no motion to have Santiago removed from the investigation, although Lacson had openly announced his desire for the Blue Ribbon to step in.

Lacson has criticized Santiago’s strict application of the Rules of Evidence during the hearings and even noted that the hearing last Feb. 12 appeared orchestrated.

Lacson said Santiago should not have terminated the hearing after only two or three hours. “But all’s well that ends well,” Lacson said of the change, which was decided in a caucus.

Santiago said she was not bothered by the development, which she even called a “win-win” solution. She also said her committee would no longer subpoena World Bank country representative Bert Hofman.

“If this is the case, my committee will be happy to limit itself to economic affairs, because, after all, that is the eponymous name of my committee. The committee is named economic affairs,” Santiago said. “After that, if there is a senator who wishes to pursue the criminal angle or the accountability of a public official or a public figure, then that senator should file a resolution and the Senate President will assign it to the proper committee, perhaps to the Blue Ribbon committee,” she said.

“In the meantime, the economic affairs committee and the two secondary committees will first finish this particular investigation on the economic angle of the World Bank case,” Santiago pointed out.

She also said she is ready to meet with Hofman in an “informal setting.”

“Since he has requested for an informal setting, we presume that he means not the formal setting of a public hearing. Perhaps, he prefers an informal conference where he would explain to us the nature of the World Bank documents,” Santiago said.

She also said the Senate agreed to set conditions for the use of the Rules of Evidence, and that the senators would apply the Senate Rules of Procedure, particularly the Rules Governing Inquiries in Aid of Legislation, which stated that as much as possible, “technicalities shall be waived, except when substantive rights of an accused person are involved.”

“The substantive rights of an accused person are those enumerated in our Constitution. The Senate will strictly follow the Rules of Evidence with respect to the substantive rights of an accused – for example, the presumption of innocence of an accused person, his right against self-incrimination, and his right to confront the witnesses against him,” Santiago said.

Santiago said it was she who suggested that her committee be allowed first to finish its investigation of the economic aspect of the World Bank allegation.

Santiago said she also hopes to benefit health-wise from the changes.

“I have, as one of the symptoms of my chronic fatigue syndrome, arrhythmia, which is irregular heartbeat, that and I am palpitating right now. That is why I am breathing like I just ran up several flights of stairs,” she said.

“Actually, I did not even want to hold committee hearings. But since the matter of the World Bank fell on my lap as chair of the proper committee, I did not want to be absent because that would have triggered a string of media stories and speculation about why I was absent and that I was just trying to avoid the controversy,” she said.

“That is why I am very happy about the result of the caucus,” she added.

Blue Ribbon ready

Sen. Richard Gordon, chairman of the Blue Ribbon committee, said his committee is ready to take over the probe from Santiago’s committee.

“It is not for us to investigate the World Bank but the allegation of collusion. The Blue Ribbon committee will investigate the allegation to aid the Senate in drafting laws that would strengthen the country’s campaign against corruption,” Gordon said.

Malacañang said it welcomes a World Bank offer to brief officials on its findings regarding the alleged road bidding anomalies.

“Anything that will contribute to clarifying the issue would be a positive development, and what are the issues everyone is looking at? It is the issue of the names of those who have been involved,” Executive Secretary Eduardo Ermita said.

“Again, there have been so many insinuations about certain names, it’s one thing to name people, and it’s another to support it with facts and evidence,” he said.

“It’s not enough that you get a piece of paper from anywhere, and get some names and say ‘yeah these people are probably involved,’” he said.

Mr. Arroyo said the allegations against him are hearsay and that nobody has come forward to submit evidence or substantiate the claims against him.

Ermita also welcomed reports that the World Bank has allowed Ombudsman Merceditas Gutierrez and Finance Secretary Margarito Teves to share information contained in the findings.

Disappointed

United Opposition president and Makati City Mayor Jejomar Binay said the Senate may have “lost its independence,” judging from way it conducted the hearing on the World Bank allegation.

“You cannot fault some sectors and the people if they begin to see the Senate as having lost its independence,” Binay said.

He said that at the Senate’s last hearing on the issue, some senators appeared to have “ganged up” on the World Bank and showed restraint in dealing with accusations against the First Gentleman.

“They were quick to clear Mr. Arroyo, even quicker to indict the World Bank,” he said.

Binay said the people showed their dismay at the Senate at a meeting among local opposition leaders and representatives of civil society groups.

“They are disappointed with the Senate. The upper chamber has traditionally been an independent institution. And when the people voted for the candidates of the opposition in 2007, they were voting for a Senate that would continue the tradition of independence,” he said.

Binay noted that under the Arroyo administration, the judiciary and the Senate have managed to stall attempts to suppress democratic rights.

The Senate, he said, has also “cast sunlight on the many large-scale irregularities” involving the Arroyo couple and their political allies.

“When the Senate surrenders its independence, it will only be the judiciary that stands in the way of Mrs. Arroyo’s plans. But even the independence of the Supreme Court will be tested this year, when Mrs. Arroyo appoints seven new justices,” he said.

Change in procurement law pushed

Sen. Francis Escudero, meanwhile, is pushing for amendments to the Government Procurement Reform Act to make the bidding procedure for big-ticket infrastructure projects more resistant to manipulation.

Escudero said that under the existing law, the president could exempt the procurement of certain infrastructure projects, goods and services from the government procurement law “in deference to the contracting law or a loan or credit” deal with a foreign lending institution.

“We need to remove the blanket authority given the president over foreign loans and credits with a lending institution,” he said.

In an interview, the senator also maintained that the law should be amended so that foreign agencies would not be able to dictate who should supply or implement the projects.

“We should be the one dictating since we will be paying for that. The law must be amended to clarify that the Government Procurement Act will apply even to bilateral agreements and executive agreements entered into by our country with another foreign government,” he added. – With Paolo Romero, Mike Frialde, Sheila Crisostomo - By Aurea Calica (Philstar News Service, www.philstar.com)

Source: Link Here
